You can cancel a contract, without consequence or needing to give a reason, within seven days of receiving goods or a confirmation of order. In the case of services, you can cancel within seven working days of making a contract. In some countries, such as Finland and Germany, the cancellation period is 14 calendar days. If a confirmation has not been given or does not meet requirements, the cancellation period is three months. If the information is provided during a period of three months, you still have seven days after that in which to cancel. In Finland, a contract is not binding on a consumer if no confirmation at all has been supplied. However, the consumer must invoke the non-binding nature of the contract within one year. If confirmation has been provided in a defective form, the cancellation period is three months. If you exercise your right of cancellation, the vendor must return the payment he has received as soon as possible and within 30 days. However, you may have to pay the costs of returning the product yourself. Bear in mind, however, that when Finnish law is applicable, the vendor must reimburse the costs if the item can be returned in the normal way by post. In Germany, the vendor is liable for the costs of returning an item only if its value exceeds €40. In Estonia, the vendor is responsible for the costs of returning the item, unless otherwise stated in the terms of contract. Even in this case, the consumer s return mail costs should not exceed €10. If you have been granted a consumer credit, which has been agreed between the vendor and a credit provider, to finance the deal, this lapses without consequences for you if you exercise your right of cancellation.
This right does not apply to newspaper and magazine subscriptions nor to betting and lottery services. Audio or video recordings or computer programmes that have been delivered sealed cannot be returned if you have broken the seal.
Products that have been made to the customer s specifications (for example made-to-measure garments or engravings), that are obviously personal or which can not be returned for re-sale or are highly perishable are likewise exceptions.
If the price of a good or service depends on a fluctuating rate on a financial market or if the service has been commenced, with your agreement, within seven days, you cannot cancel.
Remember also that, although you can examine a product, the right of cancellation does not apply if you have begun using it. However, if the product is faulty, you are entitled to have it repaired or exchanged for one that is in perfect condition.
