The vendor’s obligation to provide information

In good time before a contract is made, the vendor must provide the following information in clear and understandable language:

  • the identity and address of the business if the vendor requires payment in advance  
  • the main properties of the good or servicethe price, with taxes, of the good or service delivery costs (if necessary)
  • the terms concerning terms of delivery, payment or fulfilment of the contract the right to cancel a contract (excluding exceptions)
  • the costs of using a telecommunication device, if there is any charge for this other than the basic price (for example a telephone number for which there is a charge)
  • the period for which an offer or price is valid the minimum period of duration of the contract if it concerns continuously or continually supplying goods or services

When you are contacted by telephone, the person calling you must immediately make it clear that the call has a commercial purpose and tell you the identity of the business that is calling you.
 
The information listed above – with the exception of the latter three items – must be confirmed in writing or some other permanently accessible way when the contract is being fulfilled, or not later than when the good is handed over, unless the data have already been supplied in a permanent form.
 
In addition, the following information must be given:

  • the terms on which the right of cancellation can be exercised and the procedure to be followed when doing this, or else a clear statement that no right of cancellation exists
  • the vendor s street address
  • post-sale services and guarantees
  • the terms of cancellation if the contract has been made for an indefinite period or longer than one year

If the transaction involves a service that is performed once by using a telecommunication device and the invoicing party is the supplier of the communication device, no confirmation need be given apart from supplying the street address.
